The continues process units have been exempted from scheduled electricity cuts as per sale circular dated 13.02.2007 issued by respondent No.2.

Petitioner-Company has been denied the lawful exception in view of aforesaid sale circular for no justifiable reasons.

Precisely for the aforesaid grievance, the petitionercompany has already approached the respondents by way of moving a representation dated 22.04.2022 before respondent No.2 but the same has not been decided so far. At this stage, learned counsel for the petitioner submits MOHMED ATIK 2022.05.11 14:39 I attest to the accuracy and integrity of this document

CWP-9873-2022 that the petitioner would be satisfied in case its representation is directed to be decided by respondent No.2 by disclosing the reasons for unnecessary cuts qua electric supply of the petitioner-Company.

Notice of motion.

On the asking of the Court, Mr. Vivek Chauhan, Addl. A.G., Hayrana accepts notice on behalf of respondent No.1. In view of nature of order which this Court proposes to pass, there is no necessity of calling upon any response from the respondents at this stage, as no order prejudicial to the interest of any party is being passed.

This writ petition is disposed of by directing respondent No.2 to decide the representation dated 22.04.2022 moved by the petitioner-Company strictly by adhering to the entitlement of the petitioner-Company factually as well as on the basis of applicable sale circular keeping in view the nomenclature of the petitioner-Company.

Let the needful be done in the aforesaid context within the a period of three weeks from the receipt of certified copy of this order.
