The petitioner was allegedly found in possession of 180 grams of intoxicating powder containing Diphenozxylate Hydrochloride. Counsel for the petitioner submits that the petitioner had been granted the concession of interim bail from 21.10.2015 to 11.12.2015, during the waiting period of receipt of report of Chemical Examiner. It has been submitted by counsel for the petitioner that the petitioner has not misused the concession of interim bail and that he may be granted the concession of regular bail in view of his conduct during the period of interim bail.

I have heard counsel for the petitioner and considered the facts and circumstances of the case. No witness has yet been examined. The petitioner has been in custody since 11.12.2015, besides the earlier period of six months.

The petition is disposed of with a direction that in case the prosecution agency fails to conclude the entire prosecution evidence within a period of five months, after the next date of hearing fixed before it, the petitioner will be at liberty to approach this court again for regular bail March 11 ,2016 ( M.M.S.BEDI ) TSM JUDGE
