***** GURVINDER SINGH GILL, J. (Oral) The petitioner seeks grant of regular bail in respect of a case registered against him vide FIR No.693 dated 20.08.2017, under Section 379B, (Sections 411, 420, 482 IPC added later on) at Police Station Surajkund, District Faridabad.

The FIR was lodged at the instance of Harsh Kothari, wherein he alleged that he was owning one Audi Q3 car which was driven by his driver Maheshwar Mukhiga and that on 19.08.2017, when his driver was coming to the office of the complainant, then two persons stopped the car and when the driver rolled-down the window, the said two persons snatched the car at gun point.

Notice of the petition was issued to the State. Mr. Navdeep Singh, AAG, Haryana, has put in appearance on behalf of the State. While learned counsel for the petitioner has submitted that the petitioner is sought to be implicated solely on the basis of disclosure statement of the co-accused, learned counsel for the State has submitted that on 23.02.2018, the stolen car was recovered from possession of co-accused

Joy Vij and Nitesh Shastri and that during interrogation of Nitesh Shastri, he had disclosed that he had purchased the car, in question, from the petitioner for an amount of Rs.1.5 lacs. It has also been informed that the petitioner is also involved in other similar cases.

Having heard learned counsel for the petitioner and also the learned State counsel, and bearing in mind that the challan, in the present case, has already been submitted and that the petitioner is behind bars since last six months, in my opinion, no useful purpose would be served by detaining the petitioner behind bars. Petition is hereby accepted. The petitioner is ordered to be released on bail subject to his furnishing bail bond/surety bond to the satisfaction of the trial court.
