The petitioners seek quashing of FIR No.18 dated 7.8.2013 u/s 420/120-B IPC registered at NRI Police Station Moga, at the instance of complainant Gurbhagat Singh alleging that the petitioners had received money from the complainant but had not issued visa, as promised, on the basis of compromise.

The statements of the parties have been recorded before JMIC, Moga regarding matter having been compromised. Order declaring the petitioners proclaimed offenders has ceased to exist with the appearance of the petitioners before the trial court. In view of matter having been compromised, following the Full Bench judgment of this court in Kulwinder Singh and ors vs. State of Punjab and anr 2007(3) RCR (Cr.) 1052, I deem it appropriate to quash the FIR and all the proceedings emanating therefrom. Accordingly, the petition is allowed, the above said FIR and all the criminal proceedings emanating therefrom are hereby quashed, subject to petitioners depositing a total sum of Rs.10,000/- with the Mediation and Conciliation Centre, Punjab and Haryana High Court and another sum of Rs.10,000/- with the Punjab Police Welfare Fund, Sector 9, Chandigarh, within a period of one month.
