(ORAL) [1] By way of this petition filed under Section 482 Cr.P.C., petitioner prayed for issuance of appropriate directions to official respondent Nos.2 and 3 to take strict legal action and to arrest the accused in FIR No.50 dated 20.03.2022 under Sections 148, 149, 323, 302, 506 IPC and Section 25 of Arms Act registered at Police Station Bicchor, District Nuh.

[2] As per the status report filed by way of affidavit dated 28.09.2023 of Shri Suresh Kumar, HPS, Deputy Superintendent of Police, Hathin, District Palwal, after concluding the investigation, final report under Section 173(2) Cr.P.C. has already been filed before the Area Magistrate. Trial is now pending in the Court of learned ASJ, Palwal wherein, charges have been framed. Status report also reveals that 02 more accused namely Irshad and Khalid sons of Hasan are yet to be arrested and efforts are being made to arrest them. 2024:PHHC:024446 CRM-M-19126-2023 -2- [3] It is further stated in the report that on the basis of evidence and verification, no evidence was found against Hanif, Umar Mohammad and Ajru @ Ajruddin besides Asfak to be involved in the crime. Similarly, involvement of Parmina, Jubeda and Anisa was not filed in the crime.

[4] In view of the aforesaid report received from the respondentState, this petition is hereby disposed of with liberty to the petitioner to avail other alternative remedies available to him in accordance with law, in case he is not satisfied with the report.
