**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks pre-arrest bail in criminal complaint No. COMI-19-2015 dated 3.3.2015 titled as Pooja Vs. Vinay Kumar etc under Sections 406/498-A/34 IPC pending in the Court of learned Judicial Magistrate 1 st Class, Sri Muktsar Sahib.
Notice of motion was issued and interim protection was granted.
As per office report dated 23.11.2015, service is complete. However, nobody is present on behalf of the complainant-respondent No.2.

Criminal Misc. No. M-34535 of 2015 Learned counsel for the petitioner submits that in compliance of the order passed by this Court, petitioner surrendered before the learned trial court and his bail bonds/surety bonds have been accepted. He further submits that in such a situation, custodial interrogation of the petitioner would not be required. He prays for allowing the present petition.
Learned counsel for the State, on instructions from HC Harpinder Singh, submits that since it was a complaint case, he has nothing to argue in the matter.
In view of the above and without commenting anything on the merits of the case, at this stage, lest it should prejudice the rights of either of the parties, instant petition is allowed and the order dated 8.10.2015 passed by this Court is hereby made absolute, however, subject to the conditions envisaged under Sections 438 (2) Cr.P.C. Disposed of, accordingly.
