Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.178 dated 31.07.2014 under Section 420 IPC, registered at Police Station Sarabha Nagar, Ludhiana.

I have heard learned counsel for the petitioner and have gone through the record.

The FIR in the present case has been registered on the basis of the application sent by Sunita Arora to the Commissioner of Police, Ludhiana. As per the allegations, Sanjeev Kumar entered into agreement to sell the property for `98 lacs and he received `85 lacs as earnest money but later on failed to execute the sale deed. The complainant came to know later on that the petitioner has already obtained a huge loan on the property in question and the same has VINEET GULATI 2015.10.09 16:07 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-34545 of 2015 -2already been mortgaged with the bank. It is further alleged that intention of the accused from the very beginning was to cheat the complainant.

Keeping in view the facts and circumstances of the present case and in view of the serious allegations of cheating against the present petitioner, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail.

Therefore, finding no merit in the present petition, the same is dismissed.
