RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Jagat Pal @ Raju in a case arising from FIR No.142 dated 09.06.2018 registered under Sections 379, 380, 411, 413, 457, 473 and 34 IPC at Police Station Meharban, District Ludhiana.

According to the prosecution, petitioner along with co-accused Ramesh Kumar Paswan was found in possession of stolen items riding on a stolen motorcycle.

Learned counsel for the petitioner inter alia contends that petitioner is in custody since 09.06.2018. Co-accused of the petitioner, namely, Ramesh Kumar Paswan has been granted bail by this Court vide order dated 23.08.2018 passed in CRM-M-34514 of 2018. Treating the case of the petitioner on the same parity, he may also be granted bail during trial. Conclusion of trial may take a sufficient long time. Considering overall facts and circumstances and treating the case of petitioner on the same parity as that of his co-accused, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
