*** As per report received from Mediation Centre, petitioner had not gone there for mediation. A perusal of the file goes to show that petitioner has not been appearing in the mediation despite being summoned there. He has also not complied with the order for payment of 10% of the disputed amount. Under the circumstances, the petition cannot proceed since Notice of Motion had been issued as counsel for the petitioner had contended that petitioner was ready and willing to have a settlement with the complainant and would make payment, if found due and it was at his instance that the matter was referred to the Mediation and Conciliation Centre of this Court. The petitioner having not complied with the terms and conditions imposed and directions issued by this Court, the petition cannot proceed further and is dismissed accordingly. (H.S.
