(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 212 dated 18.06.2016, registered at Police Station City Matlauda, Distt. Panipat, who has been booked for having committed the offence punishable under Sections 376/376(2)(n)/389/452/506 IPC.

The real dispute between husband of the complainant and petitioner was regarding money transactions which was already settled, vide settlement deed dated 18.02.2016 (Annexure P-2) with the intervention of the village panchayat. This fact has been affirmed by SI Jagbir Sigh who is present in the Court today. He has also placed on record the FSL report dated 07.11.2016 and as per this report, Human Semen was detected on exhibit-2 (underwear) but semen could not be detected on sealed cloth parcel containing exhibit 1a and 1b of Gurpreet Kaur. FSL report is taken on record as Annexure A-1. Petitioner is in custody since 20.06.2016 Keeping in view the fact that the trial is likely to take some time to conclude, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Panipat.
