H. S. Madaan, J. (Oral) It is contended that after registration of the FIR charge for offences under Sections 323, 341, 506, 34 IPC has been framed against the accused and they are facing trial for the said offences. Although an application has been filed to frame charge for offence under Section 452 IPC also, which is non-bailable in nature, but till date the accused have not been charge sheeted for such offence. The apprehension of the accused is that if the application is allowed, they may be taken into custody by the trial Court. Under these circumstances, the petition is disposed of directing the trial Court to afford time of 7 days to the petitioners to approach the Court of Sessions for grant of pre-arrest bail, in case the accused are to be charge sheeted for offence under Section 452 IPC and during that period accused may not be arrested.
