(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 116 dated 26.06.2015, registered at Police Station Phase-I, Mohali, who has been booked for having committed the offence punishable under Sections 376/420/201/368/328/109 IPC.
As per contents of the F.I.R, petitioner solemnized marriage with the daughter of the complainant, who was 21 years old at the time of alleged incident, as per Annexure P-2 and P-3. After marriage, they were living in UP till 28.12.2014 and thereafter, when she came back to her parental house, the above said F.I.R has been lodged. Learned counsel for the petitioner has referred to the habeaus corpus petition filed by the petitioner wherein prosecutrix gave a statement that she was married with the petitioner but her marriage was under pressure and thereafter, she stated that she is living with her parents with GAURAV ARORA 2016.10.21 16:25 I attest to the accuracy and integrity of this document
Crl. Misc. No. M-35452 of 2016 -2her own sweet will. Learned State counsel on instructions from Head Constable Hem Raj stated that after framing of charges, out of 10 witnesses, none have been examined so far.
The petitioner is in custody since 19.04.2016 Keeping in view the fact that the daughter of the complainant was major at the time of alleged incident, the present petition is allowed.
