(ORAL) As the petitioner inter alia argue on the basis of the facts that the finding recorded by the authorities that the loss was caused due to the inferior quality packaging material is incorrect, petitioner is raising disputed question of fact and that too against the finding recorded by the authorities and the claim of the petitioner against respondent No.1 has been rejected.

If the petitioner wants to dispute the facts that the loss was not caused due to the inferior quality packaging material, the same has to be proved by way of evidence.

Keeping in view the above facts, counsel for the petitioner submits that he be allowed to withdraw the present writ petition with a liberty to the petitioner to impugn the order challenged in the present writ petition by filing civil suit.
