Petitioner is Managing Director of a Real Estate Developer Company (Aryan Earth Infrastructure Limited) who had offered to sell flats through another broker company under the name of KST Land Traders Private Limited. The allegations against the petitioner are that after obtaining a fake permission letter from the Municipal Corporation, Gurgaon and on its basis duped other persons while collecting huge amount of money from the investors. CRM-M 34611/2015 to be fake and other FIRs have been registered on similar allegations. This Court had granted interim protection and permitted petitioner to join investigation on one of the pleas that he was ready and willing to return the amount to investors. Learned counsel for the petitioner submits that the amount due to the complainant stands paid, but learned State counsel on instructions from ASI Surjit Singh submits that inspite of repeated directions by this Court the petitioner has failed to join investigation and cooperate for completing the investigation. In response,learned counsel for the petitioner states that he has also intimated his client in that regard on a number of occasions and is thus unable to respond to this factual aspect submitted by the learned State counsel.
Keeping in view the nature of the allegations and the fact that the petitioner has failed to join investigation, no case for grant of anticipatory bail is made out.
Dismissed.
