Petitioner seeks quashing of FIR No. 77 dated 24.02.2010 registered under sections 420/34 IPC at police station Sadar Amritsar on the basis of compromise. He has relied upon acquittal of co-accused namely Virinder Kumar Sharma. Admittedly, petitioner never appeared before the trial court. The court, thus, proceeded against the available accused namely Virinder Kumar Sharma. It appears that FIR against the said accused was quashed in CRM M-34010 of 2010 on the basis of compromise. Admittedly, no compromise was entered into with the petitioner.

Learned State counsel, on instructions from ASI Gurbhej Singh, who is present in court, informs that trial is proceeding where petitioner is regularly appearing and next date fixed before the trial court is 26.02.2016.

Under the circumstances, no case for interference in inherent jurisdiction is made out. The factual arguments raised by the petitioner can be appreciated after some evidence is led before the trial court. There is, thus, no merit in this petition. Dismissed.
