RAJAN GUPTA, J (ORAL) Prayer in the instant petition filed under Section 438 Cr.P.C is for grant of pre-arrest bail in case FIR No.122 dated 02.09.2015 under Sections 7(1) of Essential Commodities Act, 1955, Section 13,18,21 of Insecticides Act, 1966, Section 420/186 IPC and clause 7,8,28 (1)A, 28(1)D and 35 of Fertilizer Control Order, 1985 registered at P.S Raman, District Bathinda.

Learned state counsel at the outset submits that the petitioners have not been nominated as accused as yet, therefore, the petition is misconceived. She further submits that in case, it is found that the petitioners have role to play in the crime and are required by the investigating agency, three days advance notice would be given to them. In view of the statement made by the learned State counsel, present petition has become infructuous as no cause of action survives. Disposed of.
