Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.213 dated 24.05.2014 under Sections 148, 149, 452, 506, 307 IPC and Section 25 of the Arms Act, registered at Police Station City, Rohtak.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per learned State counsel, present petitioner is the main accused in the FIR and he absented from the proceedings in 2015 and was declared proclaimed offender.

CRM No.M-35636 of 2018 -2Keeping in view the facts and circumstances of the present case and fact that petitioner is main accused; he was declared proclaimed offender and could not be arrested for three years, I find that there is every chance that if the petitioner is granted benefit of bail, he may again abscond from the proceedings.

Therefore, finding no merit in the present petition, the same is dismissed.
