RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to petitioner - Jagtar Singh - in case FIR No.421 dated 02.08.2017 registered under Sections 306 and 120-B IPC at Police Station City Yamuna Nagar.

Briefly stated, one Lalit son of Jai Parkash committed suicide by hanging with a ceiling fan leaving behind a suicide note in his pocket mentioning the name of the petitioner and his accomplices, namely, Kamaldeep Singh, Udey Singh, Ansari and Sheru responsible for his suicide.

Learned counsel for the petitioner contends that there are no allegations of provocation and instigation by the petitioner to deceased Lalit for committing suicide in the suicide note.

On the other hand, learned State counsel vehemently opposed the prayer for grant of anticipatory bail to the petitioner submitting that during Ravinder Singh 2017.10.23 17:31 I attest to the accuracy and authenticity of this document investigation it has been noticed that petitioner had usurped ` 30 lakh from

-2CRM-M-34741 of 2017 the deceased on the pretext of getting him a plot purchased at Yamuna Nagar on cheaper rates. However, when the petitioner did not return the said amount nor gave him any plot, Lalit committed suicide. Though the petitioner has joined the investigation, but he is not co-operating. Considering over-all facts and circumstances, petitioner does not deserve the concession of anticipatory bail. Hence, the petition is dismissed.
