State counsel, on the instructions of SI Satbir Singh, informs that the petitioner though is responsible for certain irregularities has not been found to have got any wrongful gain at the cost of wrongful loss to any agency of Government or any Educational Institution.

The petitioner is stated to be under suspension for his misconduct.

Taking into consideration the totality of above said circumstances, it does not appear to be a case of custodial interrogation.

The petition is allowed. It is ordered that in case of arrest of the petitioner, he shall be released on bail to the satisfaction

CRM-M-34711-2015 (O&M) of arresting officer subject to the conditions that he will join investigation as and when required and will not tamper with the evidence or hamper investigation, in any manner. He will not leave India without the permission of the Court and will not commit the similar offence of which he is accused of during pendency of the trial.
