**** SABINA, J Petitioner has filed this petition under Section 438 of Criminal Procedure Code, 1973 for grant of anticipatory bail in FIR No.57, dated 13.09.2015, under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985 ('the Act" for short), registered at Police Station Nandgarh, District Bathinda.
Learned counsel for the petitioner has submitted that as per the prosecution case the bag containing poppy husk was lying under the motorcycle belonging to the petitioner. Petitioner was not apprehended at the spot. It was not the case of the prosecution that the petitioner had run away from the spot after seeing the police party.
KAPIL 2015.10.13 15:11 I attest to the accuracy and integrity of this document CRM-M-34720-2015 [2] *** In the present case at about 09:00 a.m on 13.09.2015, Assistant Sub Inspector Bhala Singh found that a bag containing 7 kg. poppy husk was lying under the motorcycle belonging to the petitioner. During the course of arguments, it has transpired that the petitioner is involved in another case under the Act. Hence, no ground for grant of anticipatory bail to the petitioner, is made out. Dismissed.
