for grant of regular bail in FIR No.20 dated 20.02.2025 under Sections 108 and 62 of Bharatiya Nyaya Sanhita, 2023 and Section 25-54-59 of Arms Act, registered at Police Station Sri Anandpur Sahib, Punjab (Annexure P-1). 2.

As per facts of the case, complainant Raj Kumar stated that his elder daughter Neha Soni @ Nancy was married to Tajinder Singh in the year 2015. His daughter was having two sons in the age group of 7 years and 5 years respectively. His son-in-law Tajinder Singh @ Prince was habitual

 of consuming drugs and he was causing harassment to his daughter Neha since long. His daughter further informed that her husband Tajinder Singh @ Prince was having illicit relations with the lady namely Rajni resident of village Bani near Sri Anandpur Sahib. His daughter told her husband to leave the company of said lady but in return he used to beat her. At times, his daughter wanted to get separated from her husband but they made her understand as she was mother of two children. There was no change in the behaviour of her husband. On 19.02.2025 he received phone call of his sonin-law Tajinder Singh @ Prince that his daughter had a fall from stairs and received injury. She was taken to Fortis Hospital, Mohali. On reaching the hospital, he came to know that his daughter was in serious condition and the Doctor informed that she had received fire arm injury. Tajinder Singh @ Prince and the said lady told him that his daughter ended her life by firing herself with revolver lying in the house. Finally, she passed away during treatment on 22.02.2025.

Learned counsel for the petitioner denied the allegations levelled against the petitioner. There was no complaint filed against him till the said occurrence. It is denied that petitioner was having illicit relations with co-accused. In-fact, she was an employee at the shop of petitioner. Deceased was having suspicion without any basis. No offence under Section 108 of Bharatiya Nyaya Sanhita, 2023 is made out. Petitioner was arrested in this case on 20.02.2025 and since then he is behind the bars. Without proper appreciation of the facts, regular bail application of Tajinder Singh was wrongly declined vide order dated 20.03.2025 (Annexure P-2).

  Petitioner is ready to abide by the terms of bail order. Therefore, his regular bail petition may be allowed.

Bail petition is opposed by learned counsel representing State of Punjab assisted by learned counsel representing complainant. It is pointed out that apart from the facts narrated in the FIR, there is a suicide note written by the deceased-victim before the said unfortunate occurrence. Present petitioner is specifically named and specific allegations for having illicit relations with Rajni Bala are mentioned in the said suicide note. During investigation, weapon and arm licence were also taken into police possession. Statement of husband of Rajni Bala was also recorded. During investigation, it was found that present petitioner along with Rajni Bala had purchased a plot jointly vide sale deed dated 28.03.2024. It was also revealed that petitioner Tajinder Singh @ Prince and Rajni Bala had gone to Prayagraj for Kumbh mela on 17.02.

2025 and the occurrence had taken place on 18.02.2025 by using the revolver of Sajjan Singh kept by the petitioner in his house which led to her death. After completion of investigation, challan is already presented on 21.04.2025 before the Illaqa Magistrate Sri Anandpur Sahib. Considering the gravity of offence, petitioner is not entitled to be released on regular bail.  5.

I have considered the arguments and have gone through the record carefully. As per the facts mentioned in the status report coupled with the alleged suicide note, there are specific serious allegations against the petitioner. Trial is at initial stage. Testimonies of complainant and other material witnesses are yet to be recorded. It is a case of unnatural death by

 using fire arm weapon. Considering the gravity of offence, I do not find a fit case for grant of regular bail and accordingly, bail petition filed by petitioner Tajinder Singh is declined.
