Mr. Vikas Lochab, Advocate, for the petitioner. Mr. Anil Kumar Lamdhaira, Addl. PP, U.T., Chandigarh. ***** SUDHIR MITTAL, J. (ORAL) The petitioner seeks regular bail in FIR No.300, dated 08.12.2004, registered at Police Station Sector 26, Chandigarh, under Sections 407 & 420 IPC.

Learned counsel for the petitioner submits that the petitioner has been in custody for more than 10 months. The trial is not likely to be concluded at an early date as 03 Pws have been examined out of a total of 11 Pws. One other criminal case is pending against the petitioner in which he is on bail. Thus, the petitioner may be granted regular bail. 3.

Custody certificate dated 23.05.2023 signed by Sh.Amandeep Singh, Addl. Superintendent, Model Jail, Chandigarh has been filed in Court. The same is taken on record. A perusal thereof shows that the petitioner has undergone actual custody of 11 months and there is one other criminal case pending against the petitioner in which he is on bail. 4.

Learned counsel for the respondent admits that only 03 Pws have been examined as yet out of a total of 11 Pws. 5.

In view of the aforementioned facts, it is evident that the trial is not likely to be concluded at an early date and that the petitioner has undergone actual custody of 11 months. Thus, I deem it appropriate to grant him regular bail. Accordingly, the petition is allowed. He is ordered to be released on bail on his furnishing bail and surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
