This petition for regular bail has been filed by petitioner - Hardeep Singh, an accused in FIR No.30, dated 19.4.2018, for offence under Section 306/34 IPC , registered at Police Station Kamboj, District Amritsar.
Briefly stated, facts of the case as per the prosecution story are that the FIR in question was registered on the basis of statement of complainant Baljeet Kaur, which she made to the police on 19.4.2018, stating therein that on 18.4.2018 she alongwith her younger daughter Ramandeep Kaur was present in her house. CRM-M No. 35729 of 2018 -2Singh had gone to Amritsar in connection with some work and at about 10.15 P.M., when she returned back home, she found that her daughter Ramandeep Kaur had committed suicide by hanging herself from the ceiling fan with Dupatta She stated that Bholi, mother-inlaw of her elder son Lovepreet Singh and her (Bholi's) son Hardeep Singh, used to level allegations against Ramandeep Kaur that she was not a good girl and was having illicit relations with their son Shamsher Shera. A few days earlier, Bholi and Hardeep Singh had come to their house at Luharka Khurd and had levelled allegations against moral character of Ramandeep Kaur. Joginder Kaur - mother of Bholi also used to support them. On the basis of said statement, formal FIR in the matter was recorded and the investigation in the case started.
The accused were arrested in this case. After completion of investigation and other formalities, challan against Hardeep Singh, his co-accused Joginder Kaur and Balwinder Kaur @ Bholi was filed in the Court on 9.8.2018 The petitioner accused had moved an application for regular bail to the Court of Sessions, which was assigned to Additional Sessions Judge, Amritsar, who vide order dated 21.7.2018 dismissed the application, as such the petitioner has approached this Court craving for grant of the similar relief, by filing the present petition , which prayer is being opposed by the State counsel. I have heard learned counsel for the petitioner, learned State counsel, besides going through the record and I find that there is no merit in the present petition.
CRM-M No. 35729 of 2018 -3The petitioner is specifically named in the FIR and it is alleged that he alongwith his co-accused had been taunting deceased Ramandeep Kaur by saying that she was having illicit relations with Shamsher Singh @ Shera. They were putting a blot on her moral character. Fed up with such insinuations and allegations, Ramandeep Kaur took an extreme step of ending her life by hanging from the ceiling fan.
Challan against the accused has been filed and the case is fixed for framing of charge. The trial is likely to begin shortly and concluded in near future. The guilt of the accused shall be determined during the trial. There is reasonable apprehension of the accused trying to tamper with the prosecution evidence, if released on bail, since he is related to the complainant and some of the other material witnesses. There is apprehension of his absconding even. As such there is no merit in the petition and the same stands dismissed. ( H.S.
