, -./ The present petition has been filed for seeking grant of interim bail for a period of eight weeks in a case arising out of FIR No. 139 dated 02.07.2025, registered under Section 105 BNS and Section 103(1) BNS (Section 238(c) of BNS added later on), at Police Station Sector-6, Dharuhera, Rewari on the ground that the petitioner is suffering from a serious ailment suspected to be cancer. The Jail authorities vide medical record dated 20.01.2026 had referred the petitioner to Safderjung Hospital, Delhi alleging that the petitioner is not being properly treated by the Jail Authorities.

Learned State Counsel has handed over today in Court a medical report from the Office of the Medical Officer, District Jail Gurugram bearing No. DJH/GGM/2026-162 dated 31.03.2026 wherein a report has been furnished that the petitioner had been referred multiple times to Civil Hospital, Gurugram for management of his complaint of abdomen enlargement and swelling on right side. The petitioner was advised for CECT Scan, X-ray, USG and various other tests . He was also referred to Safderjung Hospital, Delhi on 11.02.2026 for follow up. The specialists, Safderjung Hospital elevated and admitted the petitioner on 11.02.2026 with provisional diagonisis, abdominal lump under evaluation with T2, Diabetes Mellitus. The petitioner, however, left against medical advice (LAMA) from Safderjung Hospital on 12.02.2026. It is also reported that the appointment of the petitioner is rescheduled for 08.04.2026 and that he shall be referred accordingly as per the revised schedule.

In view of the aforesaid report, there is nothing on record on the basis whereof it may be concluded that the petitioner is not being provided due care by the Jail authorities or not being taken to the Specialist hospital for his treatment. It is also not the case that the prescribed medicine is not being administered to him.

Consequently, no compelling circumstances for allowing the present petition for interim bail are made out at this stage. The petition is accordingly dismissed.
