(Oral) The petitioner seeks issuance of a direction to the trial Court so as to expedite the proceedings of the trial in a time bound manner i.e. trial arising out of FIR No. 120, dated 10.09.2023, Police Station Khuian Sarwar, District Fazilka, under Sections 25, 25(7), 54, 59 of Arms Act and Sections 17, 18, 20 of U.A.P.A. Act.
Pursuant to issuance of notice of motion, learned State counsel has today filed status report by way of affidavit of Mr. Harish Kumar, Deputy Superintendent of Police, Sub Division Abohar, District Fazilka wherein it is deposed that the petitioner had previously been declared a 'proclaimed offender' and that as of now the trial is proceeding after framing of charge wherein out of the cited 66 PWs, 21 have been examined and MOHAN SINGH 2026.04.29 16:09 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh
CRM-M-17844-2026 (O&M) - 2 - another 3 have been given up. It is also deposed in the status report that the petitioner also stands involved in several other cases. Having heard the learned counsel for the petitioner and also the State counsel, the instant petition is disposed off with a direction to the trial Court to take necessary steps for expeditious conclusion of the trial. The State is directed to ensure that the PWs are produced before the Court for the purpose of getting their statements recorded on all such dates as may be fixed by trial Court for recording their statements. The trial Court is also directed to ensure that the PWs produced before the Court are duly examined unless there are compelling circumstances for not doing so and in which case a short date be fixed thereafter for recording their statements.
