*** NIDHI GUPTA, J. (ORAL) Challenge in the present revision is to the order dated 30.11.2018 passed by learned Additional Principal Judge, Family Court, Sonepat in a petition under Section 125 Cr.P.C. bearing CIS No. 384 of 2016 titled as 'Priyanka vs. Jamildeen' whereby the petitioner-husband has been directed to pay Rs.9,000/- p.m. as final maintenance to the respondent-wife.

The present revision pertains to the year 2019. Perusal of the order sheets shows that the matter was adjourned at request of learned counsel for the petitioner on 03.05.2019. On 13.08.2019, when this case was listed for hearing, following order was passed by a Coordinate Bench of this Court:- "There is a delay of 59 days in filing this revision petition.

Notice of delay condonation application for 29.10.2019 subject to the condition that the petitioner deposits an amount of `25,000/- in this Court to be paid to DIVYANSHI 2024.08.23 15:51 I attest to the accuracy and integrity of this document

CRR(F)-270-2019 (O&M) - 2the respondent towards travelling, miscellaneous, litigation expenses etc.

It is clarified that notice shall be issued by the branch concerned only after the aforesaid amount is deposited by the petitioner."

Office report shows that the petitioner did not deposit the above said amount. Hence, notice could not be issued to the respondent. Today also, there is no representation on behalf of the petitioner. Therefore, it can safely be presumed that the petitioner or his counsel is not interested in pursuing the present revision. In view of the above, present revision is dismissed for nonprosecution.
