RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner - Jatinder Kumar @ Narinder Kumar - in a case arising from FIR No.39 dated 05.04.2015 under Sections 379 and 411 IPC registered at Police Station Sadar Hoshiarpur, District Hoshiarpur.
Allegation against the petitioner is that he was travelling in the alleged stolen trolley.
Learned counsel for the petitioner inter alia contends that during trial the petitioner absented and, therefore, was declared proclaimed offender vide order dated 20.07.2017. Thereafter, the petitioner was arrested on 31.07.2017 and since then he is in custody. The conclusion of trial will take a long time. No useful purpose would be served by keeping the petitioner behind bars during trial.
On the other hand, learned State counsel vehemently opposed Ravinder Singh 2017.10.12 13:03 I attest to the accuracy and authenticity of this document prayer for grant of regular bail.
Considering over-all facts and circumstances, but without
CRM-M-34828 of 2017 -2expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing heavy bail bonds and surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
