RAMENDRA JAIN, J. (ORAL) Despite the case having been called twice, the petitioner has gone un-represented.

Perusal of the file shows that on previous date also, the petitioner had gone un-represented.

On instructions from ASI Rajinder Singh, learned State counsel submits that the instant petition has rendered infructuous, in view of the fact that co-accused of the petitioner who faced trial has been acquitted by the trial Court, but since the petitioner was declared proclaimed offender on 07.05.2015 and is still absconding, therefore, he could not put to trial.

In view of the above, the instant petition is dismissed on two counts i.e. as having been rendered infructuous and for want of prosecution as well.
