The petitioner had allegedly received a sum of Rs.4.50 lacs from the complainant with a promise that her son would be recruited in the Army. Co-accused Pawan Kumar and Dharam Singh have already been granted the concession of bail. Co-accused Meenu has been granted the concession of pre-arrest bail by this court. The petitioner has already joined the investigation pursuant to the interim order passed by this court. In view of the culpability of co-accused pertaining to the amount of Rs.4.50 lacs; co-accused having been granted the concession of regular bail/ pre-arrest bail; petitioner having joined the investigation; individual culpability of the petitioner being a debatable issue, can be granted the concession of pre-arrest bail.

Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. The petitioner will not leave India without the permission of the Court.
