(ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Nirmala Devi in a case arising from FIR No.115/2017 dated 29.07.2017 under Sections 420 and 120-B IPC registered at Police Station Sadar Fazilka, District Fazilka. Learned counsel for the petitioner inter alia contends that all the allegations in the FIR are against the husband of the petitioner. She has nothing to do with the cheating or whatsoever with the complainant, if any, allegedly done by the husband of the petitioner. Petitioner is in custody since 29.07.2017. The conclusion of trial shall take long time. No useful purpose would be served by detaining the petitioner in jail.
On the other hand, learned State counsel vehemently opposed the prayer for grant of regular bail to the petitioner.
