**** HARNARESH SINGH GILL , J. (ORAL) CRM-15337-2020 Case is being taken up for hearing through video conferencing. This is an application for grant of exemption from filing the original power of attorney and true typed/certified copies of Annexures. The application is allowed as prayed for.

CRM-M No. 17843 of 2020 The petitioner seeks regular bail in FIR No. 513 dated 8.8.2018 under Sections 120-B, 147, 148, 149, 302, 323 and 506 IPC, registered at Police Station Sadar Charkhi Dadri.

Learned counsel for the petitioner submits that prosecution witnesses i.e. PW-3 Pawan and PW-4 Pardeep son of Naresh have been declared hostile. Moreover, co-accused Amit, Kuldeep and Chetan Kumar have been granted the concession of regular bail by this Court. He further submits that petitioner has been in custody since 31.8.2018. CRM-M No. 17843 of 2020 (O&M) -2On the asking of the Court, Mr. Sukhdeep Singh Parmar, DAG, Haryana accepts notice on behalf of the State. Ms. Sukhveer Kaur, Advocate has appeared on behalf of the complainant and filed her power of attorney through e-mail of the Court Secretary of this Court.

Learned State counsel has not disputed the fact that co-accused Amit, Kuldeep and Chetan Kumar have been granted the concession of regular bail and the petitioner has been in custody since 31.8.2018. He has also pointed out that out of 21 prosecution witnesses, 04 witnesses have been examined.

The petitioner has been in custody since 31.8.2018. Co-accused Amit, Kuldeep and Chetan Kumar have already been granted the concession of regular bail by this Court. Moreover, out of 21 prosecution witnesses, only 04 witnesses have been examined. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
