(Oral) The allegations against the petitioner husband Vikram Gupta in this anticipatory bail application under section 438 Cr.P.C. are that after his first divorce, the petitioner has entered into a wedlock with complainant who also happens to be a divorcee on 10.9.2013. It is alleged by the complainant that her parents spent more than Rs one crore on the wedding and after 34 days of her marriage, she was forced to leave her matrimonial house as her husband was schizophrenic and there was demand of dowry. Criminal Misc. No. M-34880 of 2014 -2specific entrustment to any of the accused including the petitioner as to the dowry articles and that the petitioner has already joined the investigation could not be controverted on behalf of the State and counsel for complainant/respondent no. 2.

Keeping in view that in consequence of order of interim bail earlier passed on 10.10.2014 and that the petitioner has since complied with the conditions of the same and that culpability if any shall be determined at the time of trial, no useful purpose will be served by sending the petitioner in custody. Accordingly, the instant petition is allowed and interim bail granted to the petitioner vide order dated 10.10.2014 is made absolute till submission of report under Section 173 Cr.P.C. (challan). Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court.
