**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks pre-arrest bail in FIR No. 165 dated 3.9.2014 under Sections 498-A/34 IPC, registered at Police Station Dina Nagar District, Gurdaspur.

Notice of motion was issued and interim protection was granted.

Learned counsel for the petitioner submits that petitioner is ready and willing to join the investigation, as and when called by the investigating agency. She further submits that talks for an amicable settlement are going on between the parties. She prays for allowing the present petition.

Learned counsel for the State, on instructions from ASI Suresh Kumar, P.S. Dina Nagar, submits that since the petitioner has not joined the investigation so far, let she be directed to join the investigation.

Criminal Misc. No. M-34895 of 2014 Learned counsel for the complainant-respondent No.2 fairly states that although the talks for compromise are going on between the parties, yet the modalities thereof are yet to be finalised. Having heard the learned counsel for the parties, after careful perusal of the record of the case and giving thoughtful consideration to the rival contentions raised, this Court is of the considered opinion that petitioner is entitled for the concession of anticipatory bail.

Without commenting any further on merits of the case, lest it should prejudice the rights of either of the parties and keeping the scope of an amicable settlement open, present petition is allowed. The order dated 14.10.2014 passed by this Court is hereby made absolute, however, subject to the conditions envisaged under Section 438 (2) Cr.P.C.

Disposed of, accordingly.
