Mr. Nagar Singh, Advocate, for the complainant. RAMENDRA JAIN, J. (ORAL) Vakalatnama on behalf of the complainant superseding earlier counsel, filed in Court today is taken on record. Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Manpreet Singh @ Mani in a case arising from FIR No.195 dated 20.06.2018 registered under Sections 323, 324, 326, 427, 452, 506, 148 and 149 IPC at Police Station City Khanna, District Ludhiana.

According to the prosecution, in the intervening night of 19.06.2018, some unidentified persons armed with deadly weapons like baseball bats, swords etc. attacked complainant Jagtar Singh and caused injuries, including grievous one to him falling under Section 326 IPC with their respective weapons on different parts of his body. Learned counsel inter alia contends that the petitioner is not named in the FIR. -2CRM-M-35808 of 2018 weak type of evidence. No recovery has to be effected from him. Petitioner is behind bars since 23.06.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by keeping the petitioner in jail any more.

On the other hand, learned State counsel, assisted by learned counsel for the complainant, vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
