The petitioner has been summoned as an additional accused u/s 319 Cr.P.C. He has been in custody since 16.9.2014. Statement of the prosecutrix has again been recorded.

In view of the said circumstances, dual version having already cropped up and there being no scope of tampering with evidence, the petitioner can be granted the concession of bail. The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court, treating the case of the petitioner at par with his co-accused, who in similar circumstances has been granted the concession of bail.
