***** The present application has been filed for review of the judgment dated 18.03.2025, passed by this Court in FAO-2652-2000. Heard.
It is submitted by the counsel for the review applicants that separate compensation has not been granted on the count of 'loss of love and affection', as it was done by the court below. However, in view of the latest settled position of law, the count of 'loss of love and affection' is comprehended in the count of 'loss of consortium' only, which has been granted by this Court, while working upon the extent of compensation. Hence, on this account, there is no merit in the submissions so made. Besides the same also, it has been brought to the notice of the court that appellant No.6, namely, Gobind Bai, who was the mother of Ashok Kumar (since deceased), had died during the pendency of the appeal and her legal representatives were impleaded, vide order dated 15.02.2025. In view of the said order, the amended memo of parties was also brought on record of the other appellants, namely, Raj Rani, Poonam Valecha, Savita, Anish Kumar and Manish Kumar, who are the legal representatives of Gobind Bai, mother of deceased, Ashok Kumar.
Considering the same, there is mistake apparent on the part of this Court, while making disbursement of the compensation worked upon, as observed in the judgment dated 18.03.2025.
As observed in the said judgment, an amount of Rs.1,00,000/-, which was given to Gobind Bai, be now disbursed in equal amount to the remaining appellants.
