(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.50 dated 03.09.2019, registered at Police Station Dharamgarh, District Sangrur, who has been booked for having committed the offence punishable under Sections 22 and 29 of NDPS Act.
At the very outset, learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Further similar co-accused D.C. Singh has been granted regular bail vide order dated 08.06.2020 in CRM-M-12875-2020. In the order dated 13.03.2020 rejecting the regular bail application of the petitioner, it has been observed by the Court below that the police party gave signal to stop the motorcycle but the accused had thrown a polythene bag which was tied on the left side of his motorcycle and he tried to flee away but his motorcycle was stopped and he was apprehended by the police party. No. M- 17803 of 2020 -2Learned counsel has referred to judgment dated 23.02.2018 passed in CRM-M- 6433-2018 titled as Pawan Kumar vs. State of Punjab wherein also the petitioner was a pillion rider and was alleged to have thrown away a polythene bag, which was hedged between the driver of the motorcycle and the petitioner. This Court granted the regular bail to the petitioner.
Learned State counsel has opposed the regular bail of the petitioner on the ground that it was the petitioner who had thrown the polythene bag containing total 150 strips of Alprazolam tablets. The petitioner after seeing the police party tried to flee away from the spot. Heard.
Petitioner is in custody since 03.09.2019.
Keeping in view Pawan Kumar's case (supra) and the fact that the trial is likely to take some time to conclude, the present petition is allowed.
