The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner, in case FIR No.39 dated 23.03.2023 registered under Sections 447, 379, 120-B, 506 IPC at Police Station Doraha, District Khanna.

Vide order dated 27.04.2023, petitioner was granted the concession of interim bail in the following terms:- "Learned counsel inter alia contends that the complainant and the petitioner were co-sharers of the property in dispute and admittedly there was a history of strained relations between them. He submits that a complaint was moved by the complainant on 20.01.2023 wherein there was no allegation levelled against the petitioner of having committed theft of the trees. However, just 3 days later i.e. on 24.01.2023 the complainant moved another complaint wherein he alleged that in the month of November 2022 the petitioner along with the co-accused had committed theft of trees which were standing on his plot."

CRM-M-20218-2023 -22023:PHHC:084966 Learned counsel for the petitioner states that pursuant to order dated 27.04.2023, passed by this Court, the petitioner has joined the investigation. This fact is not disputed by the counsel for the State as well. Learned State counsel on instructions from ASI Hakam Singh states that the petitioner is no longer required for further interrogation. In view of the above, the petition is allowed and interim order dated 27.04.2023, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
