The petitioner seeks grant of anticipatory bail in respect of FIR No.12 dated 2.3.2019 under Sections 376, 500, 506 IPC, Police Station Hisar, Haryana.

The FIR was lodged at the instance of prosecutrix aged about 25 years wherein it has been alleged that she had become friends with the petitioner-Naveen Kumar who had held out a promise to marry her and that he had also established physical relations with her without her consent.

Learned counsel for the petitioner has submitted that the FIR came to be lodged under some misunderstanding and that now the complainant does not wish to pursue this matter against the petitioner. GAURAV SOROT 2019.11.26 14:51 I attest to the accuracy and integrity of this document

Learned counsel for the complainant has not disputed the aforesaid position and has submitted that a compromise has been effected amogst the parties.

Learned State counsel upon instructions from ASI Seema Rani has informed that the petitioner has since joined investigation and that his custodial interrogation is not required.

Having regard to the facts and circumstances of the case and while bearing in mind that the parties are stated to have amicably resolved their issues, custodial interrogation of the petitioner is not warranted. Accordingly the petition is accepted and the interim directions issued vide dated 12.4.2019 by this Court are hereby made absolute subject to the condition that the petitioner would appear before Investigating Officer as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
