Ms. Ruchika Sabherwal, Assistant Advocate General, Punjab. ***** GURVINDER SINGH GILL, J .(Oral) Petitioner Amarjit Kaur has filed this petition seeking grant of regular bail in respect of a case registered against her vide FIR No.95 dated 3.7.2018 under Section 15 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Kabarwala, District Sri Muktsar Sahib. The allegations against the petitioner are that she was found in possession of 10 kg of poppy husk. Notice of this petition was issued to the State. The learned State counsel has opposed the petition primarily on the ground that the petitioner already stands convicted for an identical offence for having being found in possession of 5 kg of poppy husk on an earlier occasion.

I have heard learned counsel for the petitioner and also the learned State counsel.

Having regard to the quantity of recovered contraband and also that the petitioner is a lady, the petition is hereby accepted and the petitioner is ordered to be released on regular bail subject to her furnishing bail bonds/surety bonds to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
