Present petition has been filed under Section 483 of the BNSS, seeking regular bail in case FIR No.20 dated 09.02.2026, under Sections 103, BNS, 2023, Section 25 and 27 of Arms Act, 1959 (Section 30 of Arms Act, 1959 added later on), registered at Police Station Sirhali, District Tarn Taran.

Noticing the factual aspect and also the contention of learned counsel for the petitioner, on 02.04.2026, following was recorded :- "2. FIR in the instant case was got registered at the instance of Sumanpreet Kaur, and same reads as under:- I am a resident of the above no.97811-23564, stated that address and am practicing in Tarn Taran Court after studying law. My father has passed away in the year 2023. We are 07 sisters and one brother. I am the eldest and my second number sister Sandeep Kaur, age about 21 years, is

studying B.A. LLB semester 2 at Punjab College of Law, Usma, Tarn Taran. My sister Sandeep Kaur had told me and my mother Harjinder Kaur 3-4 times that a boy studying in her class namely Prince Raj Singh son of Jagjit Singh, resident of Mallian, Tehsil and District Tarn Taran, has been harassing her a lot.

She had made a complaint of which to the management of Complete College, who did not take any notice, due to which today I came to the college with my sister Sandeep Kaur to drop her off at the college and outside the college, the boy Prince Raj Singh met us and I explained to him that he should stop harassing my sister, due to which the said boy also told me very badly that you can do whatever you want, I am not afraid of anyone, I will not leave Sandeep Kaur, so I left my sister in her classroom and started to go out, then at around 09:00/09:15 AM, said Prince Raj Singh came to the classroom after us, and as soon as he came, he fired a shot directly at my sister's head with his pistol due to which my sister Sandeep Kaur fell on the ground stained with blood and at that moment Prince Raj shot himself with the same pistol.

My sister Sandeep Kaur died on the spot. I raised noise of mar dita, mar dita then the college management also came at the spot and I told my mother Harjinder Kaur on phone. I alongwith my cousin brother Lovejit Singh s/o Kabal Singh r/o Mugal Chak Gill, after leaving my mother near the dead body of my siter Sandeep Kaur, was going to inform you that you have met. Legal action be taken against boy Prince Raj Singh s/o Jagjit Singh r/o Mallian, Tarn Taran and it may also be enquired into that how he brought pistol in the college. Statement has been got recorded to you, heard, is correct. Sd- Sumanpreet Kaur, attested Lovejit Singh above, attested Gurinder Singh SHO PS Sirhali dated 9.2.2026."

By referring to the allegations, learned counsel for the petitioner contends that the petitioner is serving in the Central Reserve Police Force (CRPF) and, on the day of the incident, he was on leave. It is submitted that his official pistol, which he used to keep with him, was lying in a locker fixed in the almirah. The petitioner's son Prince Raj Singh was studying along with a girl, namely Sandeep Kaur, in B.A. LL.B., 2nd Semester, at Punjab College of Law, Usma, Tarn Taran. It is further contended that without the knowledge of the petitioner, his son opened the locker of the almirah and took

away the pistol lying therein, and thereafter, upon getting enraged over some issue with his classmate Sandeep Kaur, shot her dead. Thereafter, he also shot himself, and thus, both of them died at the spot.

4. Learned counsel for the petitioner submits that the provisions of Section 103 of BNS, 2023 would not be attracted in the present case, and the petitioner cannot be held liable except for an offence under Section 30 of the Arms Act, 1959, which prescribes a maximum sentence of six months.

On perusal of Section 30 of the Arms Act, 1959, it appears that the said provision prescribes punishment for contravention of licence conditions or rules, but does not specifically deal with a situation where such weapon is misused for commission of a serious offence like murder, and the extent of legal liability arising out of such negligence.

6. At this stage, learned counsel for the petitioner seeks some time to prepare his submissions and thereafter address arguments.

It is undisputed fact that neither there is any allegation of causing instigation or abetment by the petitioner to his son-Prince Raj Singh, for using of the pistol or even handing over the pistol to him at any point of time before it was used, nor there is any allegation that at the time of incident the petitioner was present on the spot, therefore, his complicity prima facie of involvement in the incident of death of his own son, who killed himself after killing his classmate-Sandeep Kaur is not firm and same to be established unless some strong evidence is brought on record by the prosecution during the course of trial.

Petitioner is inside jail since 14.02.2026 i.e. for a period of 3 months and two days and even charges are yet to be framed. The petitioner is not habitually involved in the criminal cases rather has served with the Para-military Forces of the country i.e. CRPF. 5.

In view of the aforementioned, the petition is allowed. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/Illaqa Magistrate/Duty Magistrate concerned, if not required in any other case.

Any of the discussion done and recorded hereinabove, shall not be construed as an expression of opinion on the facts of the case. Therefore, trial Court is expected to decide the case by taking an independent view, on the basis of evidence available on record, as expeditiously as possible in accordance with law.
