******* GIRISH AGNIHOTRI, J. (Oral) The matter has been taken up through video-conferencing on account of restrictions due to outbreak of pandemic COVID-19. Petitioner-Sonu, stated to be aged 20 years, has filed the present petition inter alia with a prayer for grant of regular bail to him in case FIR No.234 dated 09.12.2020 registered under Sections 363, 366-A, 376 of Indian Penal Code, 1860 and 6 of POCSO Act, 2012, at Police Station Sarabha Nagar, District Ludhiana.

Learned counsel for the petitioner submits that the parties have, in fact, reached a compromise. In support of this, he has appended a copy of affidavit (Annexure P-2).

At this stage, Mr. Karan Padam, Advocate, appears for the complainant and supports the fact that parties have compromised the matter. Notice of motion.

CRM-M-22142-2021(O&M) -2Mr. Harsimar Singh Sitta, A.A.G. Punjab accepts notice on behalf of the respondent-State and submits that challan has been presented. There are 21 witnesses and none has been examined. In view of the peculiar facts noticed above and the present situation due to COVID-19 and also the fact that the parties have compromised the matter, this Court deems it appropriate to direct release of the petitioner on regular bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate concerned, subject to his furnishing bail bonds/surety bonds.

However, it is made clear that anything observed herein shall not be construed as an expression on merits of the case. Accordingly, the present petition stands disposed of. ( GIRISH AGNIHOTRI ) June 11, 2021.
