(Oral) This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioner vide FIR No.93 dated 29.04.2008 under Sections 406/34 IPC at Police Station City Moga, District Moga.

Petitioner was declared proclaimed offender on 26.09.2013. Thus, instant petition seeking pre-arrest bail is not maintainable. Court has also been apprised that there is a compromise between the petitioner and complainant.

In view of the above, in case the petitioner surrenders before the trial court within 10 days from today and moves an application for bail, it shall be decided on the same day.
