**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks pre-arrest bail in FIR No. 75 dated 16.8.2014 under Sections 498-A/406 IPC, registered at Police Station Sandhaur, District Sangrur.

Notice of motion was issued, vide order dated 13.10.2014 and thereafter, vide order dated 13.1.2015, arrest of the petitioner was stayed.

Learned senior counsel for the petitioner submits that since there was no direction to the petitioner for joining the investigation, he will now join the investigation and cooperate with the investigating agency, as and when required. He further submits that since the parties could not arrive at an amicable settlement before AMIT KUMAR 2015.09.24 16:44 I attest to the accuracy and authenticity of this document

Criminal Misc. No. M-35129 of 2015 the Mediation and Conciliation Centre of this Court, scope of an amicable settlement may be kept open. He prays for allowing the present petition.

Learned counsel for the State as well as learned counsel for the complainant could not oppose the genuine and reasonable offer made by learned senior counsel for the petitioner. In view of the above, instant petition is allowed. In the event of arrest, the petitioner shall be released on anticipatory bail to the satisfaction of arresting/investigating officer, subject to the conditions provided under Section 438 (2) Cr.P.C. At the first instance, petitioner shall join the investigation on or before 3.10.2015 and cooperate with the investigation agency. The petitioner is also directed to join the investigation, thereafter, as and when required by the investigation agency, by issuing a notice under Section 160 Cr.P.C.

However, scope of an amicable settlement is specifically left open.

Disposed of, accordingly.
