The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue passport with correct date of birth and spellings of her name. 2.
The petitioner was issued passport on 02.09.2009 which expired on 01.09.2019. In the said passport, date of birth of the petitioner was recorded as 01.05.1968 whereas her correct date of birth is 01.05.1966 and her name was also incorrectly mentioned as 'Gurdip Kaur' instead of 'Gurdeep Kaur'. She applied for re-issuance of passport vide application 19.10.2023 and appeared before passport authority, however, till date passport has not been issued to her.

Mr. J.K.Singla, Advocate, inter alia contends that petitioner never used previous passport. She was not even able to recall while filing the present application that she was possessing aforesaid passport. The aforesaid passport was got issued by her husband through an agent. She is an illiterate lady and mistake in the spellings of her name and date of birth was unintentional. She is not going to gain any benefit from the Government in case of minor correction of spellings of her name as well as date of birth. 4.

Mr. K.K.Jund, Senior Panel Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service. He submits that passport authority has issued show cause notice dated 16.04.2024 calling upon the petitioner to explain her position with respect to previous passport. The petitioner may be directed to appear before passport authority alongwith requisite documents and reply to the show cause notice. 6.
Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 09.05.2024 alongwith requisite documents and reply to show cause notice. On doing so, the passport authority would pass an appropriate order within six weeks from 09.05.2024.
