"#  $ Allegations against the petitioner Pawan alias Happy in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.203 dated 29.09.2014 registered at Police Station Uklana, District Hisar under Sections 307/332/353/186/148/149/427 IPC and Section 25/54/59 of the Arms Act, are that on 29.09.2014 police party headed by SI Mukesh Kumar accosted the accused including the petitioner, who had fired in the air.   Contentions of the learned counsel for the petitioner that petitioner is in custody since 29.09.2014, for a period of more than one year, and neither it is a case of injury nor any recovery of empties from the spot has been made, and that similarly placed co<accused Navdeep has been allowed regular bail by this Court vide orders dated 20.08.2015, could not be controverted by learned State counsel. Keeping in view the incarceration already undergone by the petitioner, in the light of principle of parity coupled with the fact that the investigations and so the trial will take a long time to conclude, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of trial Court. The present petition stands disposed off accordingly. #  !
