(Oral) The petitioner through instant petition under Section 482 Cr.P.C. is seeking setting aside of order dated 07.11.2022 whereby Additional Principal Judge, Family Court, Gurugram, in MNT Case No.215 of 2020 dated 25.09.2020 titled as "Piyush Nayak vs. Pramod Kumar Nayak" has struck off the defence of the petitioner. Learned counsel for the petitioner inter alia contends that the petitioner first time appeared before the Family Court on 07.07.2022 and thereafter tried to get reply prepared and filed, however, on account of nonavailability of few documents, reply could not be filed by 07.11.2022 and the Family Court by impugned order dated 07.11.2022 has struck off defence of the petitioner. The next date before the Family Court is 18.07.2023.

Without commenting upon merits of the case, the petitioner is granted one more opportunity to file reply subject to payment of costs of ANJU GOEL 2023.04.24 17:44 I attest to the accuracy and integrity of this document
