The petitioner along with Happo, Vishal, Rajan, Raja and Hardial Singh and 7/8 other persons, had allegedly assaulted the complainant- injured Vipul. A perusal of the FIR indicates that the petitioner has not been attributed any specific injury and co-accused of petitioner Rajan, who has been attributed injury with a base ball bat on the person of Vipul, has been granted the concession of bail. The injury with a fire arm is attributed to co-accused Happo on the leg and shoulder of Vipul. So far as the petitioner is concerned, no specific injury has been attributed to him. Even the motive against Vipul has been attributed to Happo. Taking into consideration the fact the petitioner has been in custody since February, 2015 and only one witness having been examined till date, the petitioner deserves to be released on bail.

The petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
