Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 167 dated 8.9.2015 under Section 3, 4, 5, 6 of Prevention of Immoral Traffic Act, 1956 ('Act' for short), registered at Police Station City Sunam, District Sangrur.
Learned counsel for the petitioner has submitted that co-accused of the petitioner were granted bail by the Trial Court. So far as the petitioner is concerned, she was declined bail on the ground that another case under the Act had been registered against her. However, in FIR No. 113 dated 27.6.2008 under Section 3, 4, 5, 6 of the Act, registered at Police Station City Sunam, petitioner has been acquitted by the Trial Court vide order dated 16.7.2013. Learned State counsel,on the other hand, has opposed the petition.
Petitioner is in custody since 8.9.2015. Since in the present case, co-accused of the petitioner are already on bail and so far as the petitioner is concerned, she has been acquitted in the other case registered against her under the Act, it would be just and expedient to order the release of the petitioner on bail.
Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of Chief Judicial Magistrate, Sangrur.
