Petitioner prays for anticipatory bail in FIR No.151 dated 08.09.2014, under Sections 420/406/506 IPC, registered at police station City Gurdaspur, District Gurdaspur.

It is contended that there is a dispute between the wife of petitioner, namely, Harwant Kaur and complainant - Balwinder Kaur. Harwant Kaur and Balwinder Kaur are real sisters. CRM No.M-351 of 2015 [2] is pending between the parties. Petitioner is stated to have joined investigation and no useful purpose would be served by taking him in custody. Learned counsel for the State, on instructions from ASI Jasbir Singh, submits that the petitioner has indeed joined investigation and he is no longer required for custodial interrogation. No recovery is to be effected from him. There is no other case pending against the petitioner. There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. In view of the above but without commenting or expressing any opinion on the merits of the case, order dated 15.01.2015 is made absolute. Petition is allowed.
